1. Age Restriction (Strictly 18+)

The service is technically and content-wise intended strictly for persons over 18 years of age. By creating an account, you declare that you meet this condition. We have a strict ban on registration for minors. As soon as an administrator acquires a reasonable suspicion that a profile was created by a person under 18 years of age, it constitutes a severe violation of these terms, and the account will be immediately deleted.

2. Third-Party Games and Content (Limitation of Liability and Copyright)

Gameson.site functions primarily as an aggregator. All games are hosted on external third-party servers and run in a technically isolated window (iframe). The loading of this isolated window and the establishment of a connection with the external server occurs exclusively based on your active instruction (by clicking the "Play" button). By doing this, you instruct your browser to connect with a third party.

Launched games may contain their own tracking scripts, advertisements, or third-party cookies, which are fully managed by their operators and over which we have no control. You acknowledge that you initiate this connection yourself as a user and launch the game at your own technical and legal risk.

To the maximum extent permitted by applicable law, the operator of Gameson.site bears no responsibility for the content, functionality, security, or privacy policies of games provided by third parties.

Notice and Takedown (Copyright Protection): If you are the copyright holder to any game in our catalog and request its removal, please send a formal request to [ gamesonadmin@gmail.com ]. This request must contain: precise identification of the protected work, a specific URL address on our portal, verifiable proof of copyright ownership (or power of attorney), and a good faith statement that you are authorized to act on behalf of the owner.

3. User Account, XP, and Service Availability

The owner of all account content (including XP and fictional currencies) is the website operator. Virtual property has no real monetary value.

Account Management and Infrastructure Protection: The service is provided free of charge. The Operator reserves the right to restrict or delete your account in case of a severe or repeated violation of these terms (especially: distribution of illegal content, cheating, cyberbullying, spam, or targeted harassment of other users), as well as in the event of any attempt at automated API abuse, excessive loading of our network infrastructure (e.g., DoS attacks, scraping), or in case of long-term inactivity (no login for more than 12 months).

Disclaimer of Warranties and Limitation of Liability: The service is provided on an "AS IS" and "AS AVAILABLE" basis, without any express or implied warranties. To the maximum extent permitted by applicable law, the operator bears no liability for any direct or indirect damage, lost profits, or data loss (including game progress, XP, user data, or virtual currencies) caused by outages, malfunctions, bugs, or technical failures of our own infrastructure or third-party infrastructure. The use of the service is entirely at your own technical and legal risk.

4. Content Rules (UGC) and Digital Services Act (DSA)

Legal Responsibility: You bear full legal responsibility for the content you upload (comments, profile pictures). It is strictly forbidden to upload content that is illegal, pornographic, hateful, or infringing copyrights.

Rights Declaration: By uploading any content (including profile pictures), you explicitly guarantee that you are the exclusive owner of the copyrights to this content, or that you have all necessary licenses and consents for its publication. The publication of your content must not infringe the rights of third parties.

By uploading content, you grant us a non-exclusive, worldwide, and royalty-free license to publicly display it and make necessary technical modifications for the duration of the economic copyrights.

DSA and Content Reporting: As a hosting service provider, we have established a point of contact for Member State authorities and users at [ gamesonadmin@gmail.com ].

Statement of Reasons and Appeal: If we remove your content or delete/restrict your account due to a violation of rules, we will send you a Statement of Reasons with a specific explanation of our decision. You have the right to appeal this decision via the contact email provided above.

5. Communication (Direct Messages)

Private messages on the portal are not end-to-end (E2E) encrypted. The operator does not blanketly monitor messages. They are read by an administrator exclusively if a message is reported as inappropriate by one of the participants (moderation and security). It is strictly forbidden to share any personal data in private messages.

6. Prohibition of Scraping and Data Mining

Any automated data mining from the Gameson.site portal (data mining, scraping, use of bots, or other scripts) for the purpose of copying our database, game catalog, or user data without the prior written consent of the operator is strictly prohibited.

Exception for Search Engines: This prohibition does not apply to automated web crawling performed by standard internet search engines solely for the purpose of indexing for public search, under the strict condition of full compliance with the rules defined in our robots.txt file (including the reserved rights against text and data mining for AI training purposes under Article 4 of EU Directive 2019/790).

7. Final Provisions

Governing Law and Jurisdiction: These terms and all legal relationships arising from them are governed by the legal system of the Czech Republic. Disputes will be primarily resolved by the courts of the Czech Republic, unless mandatory consumer protection laws grant the user the right to choose a court in the place of their habitual residence.

Changes to the Terms: The operator reserves the right to amend these terms (e.g., due to the addition of new features or changes in legislation). Users will be informed of significant changes via a notice on the website or by email at least 14 days before they take effect. If you do not agree with the proposed changes, you have the right to terminate the agreement and delete your account before the new terms come into force. By continuing to use the service after the effective date, you express your agreement with the new terms.
